Status of revisions to Alaska's oil and hazardous substance cleanup regulations (October 2008)

DEC recently adopted revisions to the Oil and Other Hazardous Substances Pollution Control regulations in 18 AAC 75. These regulations serve as the basis for decisions which are made to prevent and clean up spills and contaminated properties in Alaska. The changes took effect October 9th, 2008.
Tables of cleanup levels have been updated to reflect new toxicity information, and a number of chemicals found or suspected at Alaska contaminated sites have been added. Other substantive modifications include repeal of the groundwater "10-times rule" and technical updates to the department's Cleanup Levels Guidance and Cumulative Risk Guidance documents.

Cleanup Regulations (Chapter 75) 18 AAC 75 - Revisions Only
Revisions were made to update and modify references to regulations and guidance documents, to correct technical and editorial errors, to refine regulatory requirements and clarify the intent and propose of the regulations, to update soil cleanup levels, to modify offsite or portable treatment facilities requirements, to modify civil penalty factors, to add a timeframe for appeals, to refine the regulations to be more consistent with corresponding regulatory requirements in the Underground Storage Tank Regulations, 18 AAC 78. |

Cleanup Regulations (Chapter 75) 18 AAC 75: (December 14, 2002)
Technical corrections and clarifications were made to industrial preparedness on sections 562 and 426. Contingency plan requirement for railroads in Article 1 and 4 was also added. |
